| Breaks in Service |
A one-year Break in Service occurs in any Plan Year that a Participant does
not earn a Qualified Year.
Different Permanent Break in Service rules apply for various time periods:
- Prior to January 1, 1998: If the Participant is not vested and has incurred
too many consecutive one-year Breaks in Service, the Participant will have
a Permanent Break in Service. In the case of a Permanent Break in Service,
all accumulated contributions and Qualified Years were permanently lost. Thus,
even if the Participant later vests, the pension is determined without considering
the earlier contributions.
- Breaks in Service as of January 1, 1998 and later: There are no Permanent
Breaks in Service in which the Participant would lose all accumulated contributions
and Qualified Years. However, the Participant can incur a Permanent Break
in Service for purposes of determining the Normal Retirement Date ("NRD").
If the Participant incurs a Permanent Break in Service for purposes of determining
the Normal Retirement Date, the Participant will not lose the contributions
and Qualified Years, but lose all years of participation for determining the
Normal Retirement Date. Of course if the Participant does not vest later,
the Participant will not be entitled to a retirement benefit.
