Claims and Appeals
   
  Making a Claim

Approval or Denial of an Appeal by The Benefits Committee

If the Appeal is approved, the claimant will be notified as soon as possible. The notification will include the details of the action that is to be taken by the Plan in conjunction with the Appeal approval.

In the event the Appeal is denied, the claimant shall be notified as soon as possible, and no later than five days later than the denial. In some circumstances, the claimant may be notified that the Appeal is denied and that a more complete letter explaining the basis for the denial will be sent later.

If the Committee denies the Appeal, the claimant has the right to bring a civil suit under ERISA § 502(a). Additionally, no suit may be brought unless and until the claimant exhausts the Plan’s claims and appeals procedures.
